Trademark Act §1066 Interference

• Where a mark is so similar to a previously registered or applied for mark that confusion, mistake or deception would result from its registration, the Director of Patents and Trademarks, upon petition, may determine that an interference exists.
  • No interferences may be declared between an application and a registered mark whose right to use has become incontestable.
  • Petitions for interference are useful only for parties who would suffer irremediable damage from having to resort to opposition or cancellation proceedings.
