Trademark Act §1058 Duration of Registration

• Registrations remain in effect for ten years.
  • Between the fifth and sixth years an affidavit must be filed stating the registered goods and/or services and any goods and/or services in relation to which use has been discontinued. A second affidavit must be filed between the ninth and tenth. For both, there is a six month grace period for filing.
• §1059 allows for subsequent ten year renewal registrations by the filing of an application in the tenth year of the registration (with a six month grace period). The second of the above §1058 affidavits must also be filed in this period and may accompany a renewal application.
